WA: Q&A Why are we still referring to the Strata Titles Act 1985?

This article questions why, after WA strata legislation changes, we are still referring to the Strata Titles Act 1985.

Question: Why does the Strata industry continually refer to Strata Titles Act 1985 when that version has been superseded with the 2018 version, thus rendering the earlier 1985 version obsolete?

Answer: It is still referred to as the STA 1985 because that’s what it is.

The 1985 Act wasn’t repealed, it’s only been amended. It is still referred to as the Strata Titles Act 1985 because that’s what it is.

That’s why you’ll find a lot of drafting irregularities in the new legislation, because you have the old terms, and you’ve had different drafters over the last decade preparing the amendments, and there are some inconsistencies now in there.

So it is actually still the 1985 Act that has been updated.
