Question: Who is responsible for certifying roof anchor points in a building format plan so I can safely service my air conditioning condenser?

I own a lot in a building format plan complex. My air conditioning condenser is on the roof, and anchor points are installed, but the committee has not maintained the roof or ensured the anchor points are certified. Every air conditioning contractor I contact says they will not go onto the roof or service the condenser unless they can use certified anchor points.

In this situation, who is responsible for maintaining and certifying the roof anchor points so that I can safely arrange servicing and maintenance of my air conditioning condenser?

Answer: Anchor points on the roof are common property, and the body corporate should ensure they are up to date.

The body corporate is required to maintain common property in good condition. As your scheme is a building format plan, any anchor points on the roof are part of the common property, and the body corporate should ensure they are up to date.

If the body corporate is not maintaining the common property, you could raise the issue with them. Start by sending a letter requesting the repair. Escalate by issuing an owner’s motion or tabling correspondence at a committee meeting. If necessary, go to the commissioner’s office to seek an order requiring the works to be completed.

Could there be any exceptions to this? If there are, the body corporate should be making these explicit to you.
