Question: What guidance is available to help committees prepare a clear summary of property and appliance warranties?
I chair the committee of a 43-lot development that has been occupied since March 2024. Fourteen developer-held lots are now being sold, and we want to prepare a concise document outlining property and appliance warranties for both existing and incoming owners. Is there any general guidance available to help us with this?
Answer: Your strata manager is likely to have a resource that could assist.
While there is no generic template, you should ask your strata manager. They are likely to have a “welcome pack” for all incoming owners/occupiers in new strata buildings, which advises on such warranties and invites reporting of any perceived building defects that become apparent.
In summary, your strata manager and or building manager (if one is appointed) should assist with collating the known and or reported defects.
The warranty periods vary from scheme to scheme, as it depends on when the scheme was built and the strata plan was registered.
Generally, the non-major defects are warranted for 2 years and major defects for 6 years. However, the bond held by NSW Fair Trading under Part 11, is a separate process set out under the Strata Schemes Management Act 2015.
