ACT: Stage 2 ACT Reforms are here. What do you need to know? | Shelley Mulherin, Thomson Geer and Nina Cannell, Signature Strata – August 2023
In 2019, the ACT Government initiated a two-stage reform process aimed at modernising the ACT Unit Titles Legislation. The reforms were initially motivated by “building quality” reforms and an ACT Government planning review. Both the first and second stages of these unit title reforms have commenced. You may or may not be aware that Stage 2 officially commenced on 1st July 2023. Nina and Shelley step us through the changes and what they mean for you and your scheme.
What do you need to know about the Stage 2 ACT Government Strata Reforms? Quite a bit actually:
- Stage 1 Reforms – Refresher
- Building Management Statements – the ability to opt in
- Enhanced developer disclosure: Why are we talking about this – isn’t this old news?
- Rules and registering an up to date compilation
- Insurance requirement exemptions for both Class A and Class B + the question of excess and when can it be recovered from an owner
- Developer’s unit title applications
- Subleasing Common Property – this is an interesting one!
- Audit Requirements
- Sustainability infrastructure
- Updating section 119 Certificates – within a 4 month window

ACT: Owners Corporation Governance And Meetings | Jan Brown & Steve Wiebe, Bridge Strata + Nicole Robb, Signature Strata – November 2022
